Elder Law addresses the legal needs of seniors generally and
other specific groups with legal rights/concerns relating to health,
financial status, or diminishing/diminished mental capacity. In
the past fifteen years, Elder Law has been one of the fastest-growing
legal disciplines, not only because of the demographics of America’s
aging population, but also because of the increasing volume of
federal, state, and local provisions specifically addressing the
elderly. Because this explosion of elder-specific laws and regulations
affects seniors in so many areas, Elder Law can cover a wide range
of topics, including Medicaid eligibility; Medicare and Social
Security entitlements; guardianship; and asset protection. Elder
Law often overlaps with Estate Planning in addressing the financial
needs of the elderly.
